Litigation

Litigation today has become too expensive. We know that. We think this is true because litigation often proceeds with a view only to victory and with no consideration as to economic reality. We are convinced that both goals can be attained.

The first choice must always be to avoid litigation. Where possible, we look for every alternative solution to a problem before we will recommend that a suit be filed. Where another party is involved, we will attempt to negotiate and settle. Where a governmental agency is involved, we will try first to work with the agency to find mutually beneficial solutions. In every case, we will search for the option which will best avoid a trip to court.

If our client has been sued, the foremost component of economic litigation is a realistic analysis of the case. We attempt to avoid any activity in a case which does not afford a chance of benefit sufficient to justify the cost. When we believe that your position is not likely to prevail, we will tell you so with the hope that we can minimize damage. We attempt to plan ahead to reduce unnecessary costs. We cut the costs which do not serve a useful purpose. This, we believe, is the place to economize the litigation.

Where the matter is important, however, we play to win. We are able to bring the highest quality litigation resources to bear upon a problem. We have the manpower, the experience, and the technology to optimize your position. We do not like to lose any matter which we have chosen to contest. An economy measure which causes the loss of an important issue is a false economy.

We are highly experienced in most areas of litigation. For example, we regularly practice in state and federal courts across the State of Idaho and the Northwest. We regularly litigate matters such as antitrust, aviation, commercial, contract, civil rights, environmental, administrative, products liability, insurance, and tort disputes.
